Terms and Conditions
BLUE SPIRIT CLUB / GOLD SPIRIT CLUB
FMTG Services GmbH, Walcherstraße 1A, Stiege C2, Top 6.04, 1020 Vienna offers the following bonus programmes:
- the Bonus Club ("Blue Spirit Club")
- the Loyalty Club ("Gold Spirit Club")
The General Terms and Conditions below are applicable to both bonus programmes.
1. Eligibility and registration
All natural persons aged 18 and over and who are capable of entering into binding contacts shall be eligible to participate. Only one participation is open to each customer.
Employees of FMTG Falkensteiner Michaeler Tourism Group AG and its group companies and the companies with which a management agreement has been concluded (Falkensteiner Hotels & Residences) are not eligible to participate.
1.2. Registration to the Blue Spirit Club
Registration is via spiritclub.falkensteiner.com. After completing the application form, the applicant shall receive a confirmation e-mail containing the applicant's membership number and the login password.
Membership in the Blue Spirit Club is free.
1.3. Invitation to the Gold Spirit Club
When "Gold Spirit Status" is reached, Blue Spirit Club members, as well as other guests who are not Blue Spirit Club members, are invited to join the Gold Spirit Club. "Gold Spirit Status" is achieved when, in two consecutive years, the member/guest
- spends either at least 20 nights in the participating hotels (with each individual night being counted) or
- generates sales of at least EUR 5,000.00 (including VAT) in the participating hotels.
Hereupon, such guest shall receive a physical Gold Spirit Card by mail.
Membership in the Gold Spirit Club is also free.
The member card or membership cannot be transferred to other people.
The bonus programme benefits can be used by the member himself/herself and one fellow traveller and are applicable for up to two rooms.
2. Content of the bonus programmes
2.1. Blue Spirit Club
Members of the Blue Spirit Club get a 5% discount on all publicly bookable rates for nights booked directly at the hotel or via the website www.falkensteiner.com. No discount shall be granted if a special rate is booked (e.g. group rates, operator rates, net rates, corporate company rates).
In addition, there are regular special deals, additional discounts, news, highlights, events and prize games. These special deals are displayed and regularly updated in the Blue Spirit Club login area.
2.2. Gold Spirit Club
Members of the Gold Spirit Club get a 10% discount on all publicly bookable rates for nights booked directly at the hotel or via the website www.falkensteiner.com. No discount shall be granted if a special rate is booked (e.g. group rates, operator rates, net rates, corporate company rates).
In addition, members of the Gold Spirit Club get exclusive service, including a personal welcome gift in their room or a room upgrade based on availability. Furthermore, they are entitled to making use of all the Blue Spirit Club benefits and services.
Members of the Blue Spirit Club and the Gold Spirit Club are informed about new special offers in a regular e-mail newsletter.
3. Membership duration
3.1. Blue Spirit Club
Membership is unlimited.
3.2. Gold Spirit Club
In general, membership is limited to 2 years.
During this period, at least another 20 overnight stays or a turnover of EUR 5,000.00 (including VAT) are needed to extend membership by another 2 years. If membership is not renewed, the Gold Spirit Card shall lose its validity. But the Blue Spirit Club membership shall remain valid.
If, at a later time, the member meets the participation requirements for the Gold Spirit Club, a new Gold Spirit Card with a new expiry date shall be sent to the member by mail.
4. Participating hotels
The hotels of the FMTG Falkensteiner Michaeler Tourism Group AG accessible via http://www.falkensteiner.com/de/hotels-residences shall participate in the bonus programmes. The hotels listed there are subject to change.

5. Changes to the General Terms and Conditions and to the bonus programmes
FMTG Services GmbH reserves the right to change the General Terms and Conditions and the content of the bonus programmes and the participating hotels anytime.
Changes to these General Terms and Conditions shall be communicated to the member in writing to the e-mail address provided or in another reasonable manner. The changes shall be deemed accepted if the member fails to object in writing within one month of notification of the changes. FMTG Services GmbH shall draw the member's attention to the fact that the General Terms and Conditions have been changed and shall point out that the changes shall be deemed accepted if the member fails to object to them within one month of notification.
If the member does not accept the changes, this shall be deemed termination of membership. FMTG Services GmbH shall also point this out to the member separately when communicating the amended General Terms and Conditions.
6. Termination of membership
6.1. Termination by the member
The member is free to terminate membership anytime by e-mail to email@example.com or by calling +43 (0) 50 9911 1000 without prior notice and without providing a specific reason.
6.2. Termination by FMTG Services GmbH
FMTG Services GmbH shall be free to terminate membership for good cause without prior notice. Good cause shall be deemed given in the following cases:
- improper or fraudulent use of the programme
- inappropriate behaviour in the hotel.
6.3. Termination of the bonus programmes
FMTG Services GmbH reserves the right to terminate the bonus programmes at any time without providing reasons or to replace it with other programmes.
Termination of or changes to the bonus programmes shall not entitle the members to any claims whatsoever.
7. Data and data protection
FMTG Services GmbH complies with data privacy provisions (GDPR, German Federal Law for Data Protection (DSAG), Austrian Telecommunications Act (TKG)) as last amended. Personal data is only collected, used and disclosed if this is legal or the customer has consented to the data collection.
Detailed information on the processing of personal data, the processing procedures and the rights of the persons affected can be found in the data protection provisions of the Falkensteiner Michaeler Tourism Group. This information is available at https://www.falkensteiner.com/dataprotection.
Should a provision of these General Terms and Conditions be or become ineffective, the validity of the remaining provisions shall not be affected. The ineffective provision shall be replaced by a permissible provision that most closely approximates the economic purpose of the ineffective provision. The same applies to any gaps these General Terms and Conditions may contain.
These General Terms and Conditions are governed in their entirety by Austrian law to the exclusion of UN Convention on the International Sale of Goods.
The exclusive place of performance for all disputes arising in connection with the bonus programmes and the General Terms and Conditions for members, who are not consumers in accordance with Sec 1 Consumer Protection Act (KSchG), shall be the District Court Innere Stadt Vienna.
